This Acceptable Use Policy ("AUP") establishes the rules and guidelines for using the Mahalo Power LLC ("Mahalo Power") automated text messaging system, website, and related services. This policy is designed to ensure a positive, safe, and productive experience for all users while protecting the integrity of our systems.
About Our Automated System
Mahalo Power operates an automated information system that uses a combination of AI-powered responses and human oversight to answer questions about solar energy, home batteries, EV charging, energy conservation, costs, and installation options. The system is designed to provide helpful, accurate answers without pressure or aggressive sales tactics — we call this our "Very Soft Marketing" approach.
Our commitment: No pressure, no relentless badgering, only helpful answers. When our automated system does not have the answer to your question, a real person from our team will follow up.
Acceptable Uses
Our messaging system and services are intended for:
- Asking questions about solar energy, home batteries, EV chargers, mini-split HVACs, and energy conservation
- Requesting information about costs, savings, incentives, and financing options
- Scheduling consultations or requesting free estimates
- Receiving status updates on installation projects
- Managing your messaging preferences (opt-in, opt-out, message type preferences)
- Providing feedback about our services
Prohibited Uses
You may not use our messaging system or services to:
- Send or solicit spam, chain messages, or unsolicited commercial communications
- Transmit any content that is unlawful, threatening, abusive, harassing, defamatory, or obscene
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Attempt to access, probe, or test the vulnerability of our systems, or circumvent any security measures
- Interfere with or disrupt the operation of our messaging system, servers, or networks
- Use automated tools, bots, or scripts to interact with our messaging system (unless authorized by Mahalo Power)
- Collect or harvest personal information of other users
- Use our system for any purpose that violates applicable federal, state, or local laws or regulations
- Transmit any viruses, malware, or other harmful code
Our Messaging Practices
Mahalo Power commits to the following responsible messaging practices:
- Consent-Based: We only send messages to individuals who have opted in to receive them
- Respectful Frequency: We limit automated messages to no more than 10 per month (excluding direct replies to your questions)
- Appropriate Hours: We send automated messages only between 8:00 AM and 9:00 PM local time, in accordance with TCPA requirements
- Easy Opt-Out: Every message includes clear instructions for opting out; we honor all opt-out requests immediately
- Transparent Identity: Every message clearly identifies Mahalo Power as the sender
- No Data Selling: We never sell, rent, or share your phone number with third parties for their marketing purposes
- Human Backup: When our automated system cannot answer your question, a human team member will respond
System Accuracy & Limitations
Important: Our automated system provides general information based on its knowledge base. While we strive for accuracy, automated responses should not be considered professional engineering, financial, tax, or legal advice. Cost estimates are approximate. For specific project details, a human representative will provide personalized information.
Enforcement
Mahalo Power reserves the right to:
- Monitor use of our systems for compliance with this AUP
- Suspend or terminate access to our services for users who violate this policy
- Block phone numbers that are used for abusive, fraudulent, or prohibited purposes
- Report illegal activity to appropriate law enforcement authorities
We will make reasonable efforts to notify users before taking enforcement action, except where immediate action is necessary to protect our systems, our users, or to comply with legal requirements.
Regulatory Compliance
Our messaging system operates in compliance with:
- The Telephone Consumer Protection Act (TCPA)
- The CAN-SPAM Act
- CTIA Messaging Principles and Best Practices
- Twilio's Acceptable Use Policy and Messaging Policy
- All applicable federal, state, and local telecommunications regulations
